Luther advises DSW21 on EU-wide tender for transport services

Essen – Dortmunder Stadtwerke AG (DSW21), together with Flughafen Dortmund GmbH, has successfully completed the tendering of transport services to third party companies in less than four months. The awarded minimum contract volume is approximately EUR 44 million.

Background

Luther advised DSW21 on the entire multi-stage procurement project. The advice included the drafting of all contracts as well as the handling of the project as an external awarding authority for DSW21. The complex award procedure with two different clients was structured into eight different lots. Despite numerous negotiation meetings and a large number of bidders, the procedure was completed in less than four months after the Europe-wide announcement with awards in all lots.

Almost a quarter of the bus rides in DSW21's service area are provided by external companies. At the end of the three-year term, the contracts concluded can be extended by up to three further years.

The results of the award procedure were convincing from an economic point of view. DSW21 transport director Hubert Jung: "The economic prices and a very good quality concept have convinced us all round. We are thus taking another leap forward.".
